Terms of Service

1. Agreement & parties

These Terms govern your subscription to and use of the SkyQon (the “Service”), provided by SkyQon, based in Belgium. The Service is sold and fulfilled through Paddle.com Market Limited (“Paddle”) acting as our authorised reseller and Merchant of Record: your payment contract for the subscription is concluded with Paddle, while these Terms govern provision and use of the Service by SkyQon. By creating an account, starting a free trial, or subscribing, you (the “Customer”) accept these Terms on behalf of the organisation you represent.

2. The service

The SkyQon is an external monitoring service. On a schedule it performs TLS/SSL handshakes against the public network endpoints you nominate, parses the X.509 certificates presented, checks DNS, email-authentication and domain-registration signals, and alerts you to upcoming expiry and to weak or deprecated configurations; tier-dependent reporting is as described on the pricing page. No software agent is installed in your environment and no access to your internal systems is requested or taken — only the public endpoints you nominate are contacted. Features depend on the subscribed tier and may evolve.

3. Acceptable use & authorisation

You represent and warrant that you own, or are duly authorised by the owner to have monitored, every domain, host and endpoint you nominate, and that you will keep that authorisation current. You must not use the Service to scan, probe or test endpoints you are not authorised to test, to circumvent security controls, or for any unlawful purpose. We may suspend or remove monitoring of an endpoint, or suspend the account, where we reasonably believe this clause is breached or that continued scanning may cause harm, giving notice where practicable.

4. Subscription, trial & billing

A free trial is provided for 30 days from tenant activation; no payment instrument is required to begin it and no charge is made during it. Paid plans are billed annually in advance, exclusive of VAT/sales tax, through Paddle, which adds applicable taxes at checkout and issues the invoice. Subscriptions renew automatically for successive annual terms until cancelled in accordance with the Refund & Cancellation Policy. We may change plan pricing or composition on at least 30 days’ notice before the change takes effect at your next renewal; you may cancel before renewal if you do not accept a change.

5. Cancellation & refunds

Cancellation, renewals and refunds, including any statutory withdrawal right, are set out in the Refund & Cancellation Policy and are administered by Paddle as Merchant of Record. See Refund & Cancellation Policy.

6. Data protection

We process personal data as described in the Privacy Policy and, where we act as processor for Customer personal data, on the terms of the Data Processing Addendum, which forms part of these Terms. Payment data is handled by Paddle as an independent controller and Merchant of Record; SkyQon does not collect or store payment-card data. See Privacy Policy and Data Processing Addendum.

7. Service levels & availability

During a free trial the Service is provided with no service-level commitment. For paid plans we use commercially reasonable efforts to keep the Service available and to run scans at the cadence stated for the subscribed tier, but do not guarantee uninterrupted availability. Planned maintenance is scheduled to minimise disruption where practicable.

8. Warranties & disclaimers

Monitoring is provided on a best-effort basis and depends on factors outside our control, including DNS, network reachability, and the accuracy and configuration of the endpoints you nominate. To the maximum extent permitted by applicable law, and without limiting your mandatory rights, the Service is provided “as is” and we do not warrant that it will detect every certificate issue or prevent every expiry. You remain responsible for the issuance and renewal of your own certificates.

9. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability arising out of or in connection with the Service in any 12-month period shall not exceed the fees paid for the Service in the 12 months preceding the event giving rise to the claim. We shall not be liable for indirect, incidental or consequential loss, or for loss of profit, revenue or data. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, for fraud, or for mandatory consumer-protection rights.

10. Term & termination

These Terms apply for as long as you have an active trial or subscription. Either party may terminate for the other’s material breach not remedied within 30 days of written notice. On termination your right to use the Service ends; you may request export of your account data within 30 days of termination, after which data is deleted in accordance with the Privacy Policy and the DPA.

11. Governing law & disputes

These Terms are governed by the laws of Belgium. The courts of Brussels, Belgium have exclusive jurisdiction, without prejudice to any mandatory consumer-protection right you may have to bring proceedings in your country of residence. Payment disputes are handled by Paddle in accordance with Paddle’s buyer terms.

12. Changes & contact

We may update these Terms; material changes will be notified by email to the account contact and/or by notice on monitor.skyqon.com before they take effect, and continued use after the effective date constitutes acceptance. Contact: [email protected].
